If you have been made redundant recently, you may have a claim for unfair dismissal as it may not be a genuine redundancy.

For example, did your employer:

  • Consult with you in accordance with the Modern Award (if applicable);
  • Consider whether you could be redeployed within the business.

A failure to do either of the above may result in your dismissal being unfair.

However, it is important that you take legal advice as soon as possible.  You only have a short period of time following the dismissal in which to commence an application for unfair dismissal / termination.
