Separations can be a difficult time, emotionally and financially. It’s a big shake-up to your life and your children’s lives. We understand that affording a lawyer is incredibly difficult at a very uncertain time where you have more rent to pay, to go back to work, and think about making other big changes.
Corney & Lind Lawyers are aware of this, and we’ve done work around this to make legal advice accessible in your time of difficulty.
Your Costs Agreement – How can we apply this to your circumstances?
The traditional lawyer bills in six-minute units. We know that this can create uncertainty and fear for you when budgeting, and conflict between you and your lawyer.
From 1 July 2018, Corney & Lind Lawyers have sought to be as innovative and caring as possible in your difficult times by making our family law services as affordable and clear as possible.
Our family law services will now be provided fixed-fee and in stages (unless certain exceptions apply). This is so that you are able to clearly budget, and know what services will be provided and when. We want to minimise bill shock for you, and help you have better control of your finances in your difficult time.
Other funding options we have been known to offer include deferred fee arrangements. For example, some of our clients have had their access to funds completely removed by their former partners. We’ve assisted in negotiating interim payments on terms where our funds have been deferred until after settlement or a Court Order.
Settlement Strategy – Don’t take every point – focus on settlement, starting over and the big picture
Court trials can be very costly – involving barristers, witnesses and all sorts of other costs.
Successful parties in family law matters are also hardly awarded costs orders. We have found that Court can also damage relationships beyond repair, and even more so when children are brought into the Court proceedings.
Corney & Lind Lawyers bring our focus of just redemptive outcomes © to the way we approach family law matters. Where possible we want to avoid taking every point in family law matters and avoid Court. We want to work with you to keep your future in focus, and helping you achieve a redemptive outcome that is just and fair.
A partnership between your lawyer and you
While lawyers can have hundreds of clients, we know that you may only have one lawyer. Corney & Lind Lawyers want to partner with you in your difficult time and walk with you in your situation.
This means that our approach isn’t to tell you what to do. We will advise you and make recommendations, but you will have control about your situation, as you know it best.
We will work with you. This means we do not do all the work, but you can do some work to help keep our costs more affordable.
We have developed documents to make your involvement in your family law matter more straightforward and manageable, so that we are not just leading you through this time, but walking with you.
Bringing the lawyer in at the right time
We know “lawyer-ing up” too early and having a lawyer writing to your former partner can sometimes cause an unnecessary escalation and conflict.
Corney & Lind Lawyers have designed a process suitable for some separations where we will advise you on your negotiations directly with your former partner – and then assist you in finalising an appropriate binding agreement between you and your former partner.
This strategy allows you to keep costs more affordable, and gives you the opportunity to work the dispute out between you and your former partner yourselves.
